If you’re applying for a marriage-based green card through adjustment of status in the U.S., you may be wondering how long the process takes in 2025. Timelines can shift unexpectedly but here’s what we’re currently seeing as an immigration law firm focused on marriage and fiancé green cards.
💡 Download our free guide at MarriageImmigrationLaw.com for a complete walkthrough of the process (50+ pages!).
Three Main Types of Adjustment of Status (AOS) Cases:
U.S.-Based Green Card (I-130 + I-485 Joint Filing)
This applies if you’re in the U.S. and file your I-130 and I-485 together the most common route.
Fiancé Visa to Green Card (K-1 Entrants)
You entered the U.S. with a K-1 visa, got married, and are now adjusting status. No I-130 is needed here.
Married to a Green Card Holder (F2A Preference Category)
You’re adjusting status based on marriage to a permanent resident. This takes longer and has unique steps.
What’s Happening with Timelines Right Now?
1. I-130 + I-485 Joint Filings (Spouse of U.S. Citizen)
- Timeline: Some cases are being approved within 3–4 months (especially in cities like San Antonio or Los Angeles).
- Why? USCIS is using a “last-in, first-out” system newer cases are processed faster, while older ones are delayed.
- Unfair? Yes. Cases from last year may still be stuck, while newer ones are already getting interviews.
2. Adjustment of Status After Fiancé Visa (K-1 Visa)
- Timeline: Around 3 to 9 months on average.
- Tip: Visit a Social Security office within 90 days of entry to get your SSN.
- Important: Apply for work permit and advance parole early you may be stuck in the U.S. while waiting.
Decision After the Adjustment Interview
Typically, approval comes within a week after the interview. But 4 weeks if not unheard of. If longer, there may be issues.
In rare cases, approval happens the same day.
Expect the green card to arrive by mail within 7–10 days, although delays can happen.
3. Adjustment from Spouse of Green Card Holder (F2A)
- Visa Bulletin is Key: You must wait for your I-130 to be approved first before filing I-485.
- Current Wait: As of June 2025, it’s taking around 3 years from I-130 filing to green card approval.
- Recent Update: The Final Action Date jumped by 9 months, which is great news for many applicants.
Warning About Overstaying Your Visa
If you’re adjusting status under the F2A category:
- It is best to stay in status (e.g., on a B2 or F1 visa) if possible after filing Form I-485.
- USCIS may detain applicants who overstay even if their I-485 is pending.
Historical norm: Most applicants out of status were still approved.
Now: We’re seeing new, unpredictable enforcement trends.
Adjustment of status for marriage and fiancé green cards is still possible and in some cases, surprisingly fast. But the rules are shifting, and enforcement is less predictable. Always check the latest Visa Bulletin and try to maintain legal status if you can.
